Terms of Service
These Terms of Service ("Terms") are an agreement between you and Based Body System, LLC, a Delaware limited liability company doing business as Bespoke Physique Protocol ("Bespoke Physique," "we," "us"). They govern your use of the Bespoke Physique iOS and Apple Watch apps, the Bespoke Physique web planner, Signal and related AI features, and thebespokephysique.com (together, "the Service"). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy.
1. Who may use the Service
You must be at least 18 years old and able to form a binding contract. The Service is offered for your personal, non-commercial use. One account per person; you are responsible for keeping your credentials confidential and for all activity under your account.
2. What the Service is — and is not
The Service is a body-recomposition planning and tracking system: nutrition planning and logging, training programming and logging, recovery and health-metric tracking, document extraction (such as DEXA reports and blood panels), travel planning, and Signal, an AI layer that answers questions about your own data.
The Service does not provide medical advice, diagnosis, or treatment, and no physician-patient or provider-patient relationship is created by using it. Protocol-tracking features are private logging and scheduling tools for regimens prescribed and managed by your own licensed clinician. The Service does not prescribe, recommend, or sell any medication, supplement, or other substance. Always consult a qualified physician before beginning any training, nutrition, supplementation, or other health program, and before acting on any number the Service shows you. Never disregard professional medical advice because of something in the Service. If you think you have a medical emergency, call emergency services.
3. Assumption of risk
Physical training and dietary change carry inherent risk, including risk of injury. You represent that you are physically able to undertake the activities you choose to log or perform, that you have consulted a physician where appropriate, and that you voluntarily assume the risks of your own training and nutrition decisions. The Service supplies measurements and plans; the decisions — and the barbell — are yours.
4. AI features
Signal, Macro Vision, and the extraction pipelines use artificial intelligence. AI output can be wrong. Macro estimates from photos are estimates; extracted lab values should be checked against the source document; Signal's answers are computed from your data and can be incomplete or mistaken. Verify anything that matters before acting on it. AI features are subject to fair-use limits we may set to keep the Service sustainable; we'll be transparent about any limits that apply to your plan.
5. Subscriptions and billing
The Service is sold as a subscription. All billing is handled outside the app by our payment processor, Stripe — through Stripe-hosted checkout and billing pages. We never see or store your full card details. Nothing is purchasable inside the iOS app.
Current beta pricing is $9.99 per month. Your subscription renews automatically each billing period until you cancel. You can cancel any time via the billing portal link in your account or by emailing james@thebespokephysique.com; cancellation takes effect at the end of the current billing period, and no partial-period refunds are given except where required by law.
Beta pricing is temporary. When the beta period ends, standard pricing will apply (announced in advance; currently anticipated to be $19.99 per month with a six-month commitment, or $29 per month month-to-month). We will notify you by email before any price change takes effect, and continued use after the change constitutes acceptance; if you don't accept, cancel before the new price applies.
6. Beta terms
During beta, the Service is provided as pre-release software: features may change, break, or be removed; availability is not guaranteed; and data structures may evolve. We work to preserve your data across changes but cannot guarantee uninterrupted service during beta. iOS app distribution during beta is via Apple TestFlight and is additionally subject to Apple's TestFlight terms. If you send us feedback, ideas, or screenshots, you grant us a perpetual, royalty-free license to use them to improve and promote the Service — with the discretion promise that we never publish your identity or your data without your explicit consent.
7. Your data
You own your data. You grant us the limited license needed to host, process, and display it in order to provide the Service, as described in the Privacy Policy. You can request an export or deletion at any time. Do not upload content you don't have the right to use, and do not upload another person's health information.
8. Acceptable use
Don't misuse the Service. That includes: sharing accounts or reselling access; scraping, reverse-engineering, or copying the Service or its programming logic; probing or breaching security; abusing AI features through automated or excessive requests; using the Service to violate any law; or uploading malicious code. We may suspend or terminate accounts that do.
9. Intellectual property
The Service — including the apps, planner, engine logic, Signal, designs, and the Bespoke Physique brand and lion mark — is owned by Based Body System, LLC and protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the apps and Service for your personal use while subscribed. All rights not granted are reserved.
10. Apple-specific terms
The iOS and watchOS apps are distributed through Apple's platforms. Apple is not a party to these Terms, has no obligation to furnish maintenance or support for the apps, and is not responsible for addressing any claims relating to the apps or your use of them. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS and watchOS apps, and may enforce them against you. Your use of the apps must also comply with the Apple Media Services Terms and, during beta, the TestFlight terms.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA, ESTIMATE, OR COMPUTATION WILL BE ACCURATE. NO OUTCOME — INCLUDING ANY CHANGE IN BODY COMPOSITION — IS PROMISED OR GUARANTEED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASED BODY SYSTEM, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOME, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Based Body System, LLC and its officers, members, and agents from claims arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.
14. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access for breach of these Terms, for non-payment, or if we discontinue the Service (with reasonable notice and a wind-down period for data export where practicable). Sections that by their nature should survive termination — including 3, 7, and 9 through 16 — survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction. Both parties waive any right to a jury trial to the extent permitted by law.
16. Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes, we'll update the effective date above and notify you in the app or by email before the changes take effect. Continued use after the effective date constitutes acceptance.
